It is pertinent to study and understand Commercial Courts Act at this juncture in view of Sections 7, 9 and 10 of the Insolvency and Bankruptcy Code, 2016 being suspended. Hence, litigants who were earlier looking at recovering the default amounts by taking recourse to IBC will still want to pursue litigation, but will also look at options that will have a time bound hearing and disposal of the matter. Also, the other important objective of a fair and effective utilisation of scarce judicial resources cannot be lost sight of.
